In light of today’s evidence order by Civil Chamber 29 of the Berlin Regional Court regarding the action for eviction taken against the Theater and Komödie am Kurfürstendamm, Norman Schaaf, the Managing Director of CELLS Bauwelt GmbH, had this to say:
“In response to the court’s query regarding the existence of Mars PropCo 1, we cited a series of facts. These prove the company’s capacity to be a party to legal proceedings and therefore the permissibility of this justifiable lawsuit. We are of the firm conviction that our view on the matter will be confirmed on October 18, 2016, thereby finally concluding this spurious discussion which was triggered by the opposing party. After all, the whole thing is obvious anyway: Nobody should be able to use a property over a number of years without paying the associated operating and ancillary costs. The court already clearly indicated this after the first hearing in May.”
